KLBK/Fireplaces Unlimited South Plains Showers Rain Contest Official Rules (02/12/14)
This promotion is sponsored by Fireplaces Unlimited, 4811 W. Loop 289, Lubbock, TX, Everything Lubbock.com (Nexstar Broadcasting), 7403 S. University, Lubbock, Texas and KLBK-TV (Nexstar Broadcasting), 7403 University, Lubbock, Texas. Promotion is void where prohibited. By entering, each entrant accepts and agrees to be bound by these promotion rules.
Promotion Summary
Persons will be encouraged to enter their guess for the date, hour and minute of Lubbock’s official 1/4 inch of rain for the Winter/Spring 2014 season, as determined by the Lubbock office of the National Weather Service. The person with the guess closest to the actual date, hour and minute will win a Disc-it Cooking System provided by Fireplaces Unlimited.
Eligibility
No purchase necessary to enter or win. This promotion is open only to legal U.S. residents in the KLBK viewing area who are 18 years of age or older at the date their entry form is completed. Employees and immediate family members of employees of Fireplaces Unlimited, Everything Lubbock.com (Nexstar Broadcasting), KLBK-TV (Nexstar Broadcasting), KAMC-TV (Mission Broadcasting) and their respective parent companies, affiliates, subsidiaries, agents, and their advertising and production agencies are not eligible to participate in this promotion. “Immediate family” includes the employee’s children, spouses of the employee’s children, the employee’s brothers and their spouses, the employee’s sisters and their spouses, the employee’s parents, the employee’s spouse and the parents of the employee’s spouse. Adopted, half, step members, and any other persons residing at the same household location, whether or not related are also included in “immediate family”, and are therefore not eligible to participate.
How to Enter
Participants may either visit Fireplaces Unlimited, 4811 W. Loop 289, Lubbock, TX and complete an official entry form, or visit Everythinglubbock.com and complete an official entry form online. The entry sign-up period will begin on Saturday February 15, 2014 and will conclude upon Lubbock’s first official 1/4 inch of rain. In the event ¼ inch of rain is not received by April 25, 2014 a random drawing of qualifying entries will be held on April 28, 2014 to determine a winner. Only one entry per person per day will be accepted. If more than one entry form submitted in a single day is discovered, the additional entries received from that person on that particular day will be discarded.
Entrants will be asked to guess the official date, hour and minute of Lubbock’s official first ¼ inch of rain during stated contest dates.. Any seconds listed on an entry will be disregarded. The official date and time of Lubbock’s first ¼ inch of rain will be determined by the Lubbock office of the National Weather Service.
To be eligible to win, an entry must be received at least 48 hours prior to the official first ¼ Inch of rain. In the event multiple entrants are tied for the closest date, hour and minute, the entrant who submitted their entry earliest during the contest period will be named the winner.
Entries must be filled out completely and legibly in order to qualify. Sponsors (Fireplaces Unlimited, KLBK-TV, Everything Lubbock.com) are not responsible for lost, late, illegible or misdirected entries, including due to transmission, technical, and/or network failures of any kind, including, without limitation, malfunctioning or any hardware or software, human error, or any other error or malfunction. All entries become the property of the sponsors (Fireplaces Unlmited, KLBK-TV, Everything Lubbock.com), and these sponsors reserve the right to use any information submitted by entrants. Any questions regarding the number of entries submitted by an individual shall be determined by the sponsors (Fireplaces Unlimited, KLBK-TV, Everything Lubbock.com) in their sole discretion, and these sponsors reserve the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the promotion.
By entering this promotion, entrant agrees that Fireplaces Unlimited, KLBK-TV and Everything Lubbock.com may provide entrant with promotional materials and that these sponsors may release entrant’s personally identifiable registration information to each other for that purpose.
Prize Information
The qualified entrant submitting a guess closest to the official date, hour and minute of Lubbock’s official first ¼ Inch of Rain will receive a Disc-it Cooking System Valued at $500 (provided by Fireplaces Unlimited). No prize substitutions are allowed, and prize is non-transferable.
Winner Notification
The winner’s name will be announced on a KLBK-TV news broadcast following Lubbock’s official first ¼ Inch of Rain. This date is subject to change. The winner will also be notified by KLBK sales management by telephone or email within 48 hours of their selection.
Conditions of Acceptance of Prize
As proof of identity and eligibility, the winner will be required to show a valid driver’s license or other appropriate photo identification at the time the prize is presented. The winner will also be required to submit a W-9 IRS form to the KLBK-TV accounting office at the time the prize is presented. Winner will be solely responsible for any and all local, state and federal taxes, as well as any other items of an incidental nature.
Each winner agrees to the use of his or her name and/or likeness in publicity without any additional compensation, except where prohibited by law. By entering this promotion, each winner acknowledges that the sponsors (Fireplaces Unlimited, KLBK-TV, Everything Lubbock.com) have the right to publicize and broadcast each winner's name, voice, and likeness, the fact that he or she won, and all matters incidental thereto.
Limitation on Liability
By entering this promotion, each entrant forever discharges and releases the sponsors (Fireplaces Unlimited, KLBK-TV, Everything Lubbock.com ) and their parent companies, subsidiaries, affiliates, and their respective directors, officers, employees, and agents from any and all liability, claims, causes of action, suits, and demands of any kind arising from or in connection with the promotion, including, without limitation, responsibility for property damage, loss of life, or personal injury or death resulting from or in connection with participating in the promotion or from or in connection with use or receipt of the prize, however caused.
Sponsor's Reservation of Rights
These official rules are subject to modification by the sponsors (Fireplaces Unlimited, KLBK-TV, Everything Lubbock.com). In the event of a dispute, all decisions made by the sponsors are final and binding. The sponsors (Fireplaces Unlimited, KLBK-TV, Everything Lubbock.com) reserve the right, in their sole discretion, to disqualify any person who tampers with the entry process, or who otherwise acts in violation of these official rules. The sponsors further reserve the right, in their sole discretion, to cancel, terminate, or modify this promotion if, for any reason the promotion is not capable of completion as planned (including, but not limited to, for the following reasons: infection by computer virus, technical corruption, force majeure, or non-authorized human intervention that compromises or affects the administration, fairness, integrity, security, or proper conduct of the promotion).
